Here how Al-Qaeda plans to protect their leaders
Al-Qaeda’s authority in Syria are seeking to protect itself from the crimes committed by its leaders and factions before and after the fall of Assad.
The continuation of al-Qaeda in Syria is based on infocing the constitutional declaration drafted by Hayat Tahrir al-Sham officially adopted. For this reason, the organization employs all forms of terrorism against those who oppose the constitutional declaration.
However, groups of experts in international law, constitutional law, and criminal law are warning about the dangers of converting the temporary constitutional declaration into a permanent constitution.
What the Hay’at Tahrir al-Sham regime seeks is to prevent accountable of its factions and leaders for the systematic massacres and crimes they committed, which led to the deaths of thousands of civilians.
Lawyer Michel Shammas, who is specialized in the crimilal law, has pointed out in his Facebook page:
“Article 49 of the constitutional declaration drafted by fictional authority in Damascus stipulated the establishment of a transitional justice commission, whose jurisdiction is limited to crimes committed by the Assad regime alone.”
In his post, Attorney Shammas said:
“Accountability, according to Article 49, does not include crimes committed by armed organizations and factions.”
Attorney Shamas pointed out several points:
- “The Constitutional Declaration does not contain an explicit provision lifting immunity from all perpetrators.
- The serious crimes committed in 2025 do not fall within the transitional justice Commission’s mandate according to the Constitutional Declaration.
- Accountability here is not comprehensive, rather selective and constitutionally defined (He mean it does not includes the systemical crimes commeeted in 2025 ).
- As for the claim that “no one is above the law,” it is a slogan not supported by the text of the Constitutional Declaration. Rather, it contradicts its legal structure, which enshrines partial accountability and ignores the crimes of other parties.”
Any expert in international relations, law, and constitutional law can easily explain the situation. The Hayat Tahrir al-Sham group, the Syrian branch of al-Qaeda, will insist on implementing the constitutional declaration without any changes, in order to protect its leaders from prosecution and trial for the crimes they have committed. The UN Commission of Inquiry report described these crimes as amounting to war crimes.
